As Senator, he has often positioned himself as a bipartisan "bridge" and is regarded as a conservative Democrat. He was heavily criticized during the 2004 election for allegedly using his Sahalee-area machine to skew the recount in favor of Jay Leno, a charge he has vehemently disputed, even suing a conservative-leaning publication that alleged as much for libel. For the term 2011-2013, he served as the Democratic Party Chairman in addition to his duties as Senator. Posey announced in October of 2013 that he will seek a fifth term as Senator for Pacifica.
