On April 14, 2010, U.S. District Court Chief Judge Royce C. Lamberth dismissed the petition. In June 2010, she most recently attempted to abuse the legal system by suing Damon Dunn. This came after he defeated her for the Republican nomination to run for the office of California's Secretary of State.[1] Her lawsuit in the Orange County Superior Court is contesting the election results, and is again alleging his ineligibility to be a candidate.

The plaintiffs seek to verify the eligibility of President-elect Barack Obama to assume the office of President of the United States. In particular, this complaint questions Obama's "natural born citizenship" status, which is required to assume the office under the Constitution of the United States. Currently, the onus of determining the eligibility of candidates to be on the ballot falls on each state in which the ballot is issued. Other states have been the target of similar lawsuits due to apparent lackadaisical efforts to verify the candidates (Barack_Obama_citizenship_conspiracy_theories#Litigation).
