by user Awrigh01 Yesterday, a 5-4 Supreme Court made the first pro-life ruling, upholding a 2003 law that banned what "partial-birth abortions." Justice Anthony Kennedy wrote for the majority. Kennedy's opinion said that the Court was upholding the law's facial language. Therefore, lawsuits challenging the law should not have been allowed in court, as on its face, the law was OK. __NOEDITSECTION__ From The Opinion Wiki, a Wikia wiki. The proper way to make a challenge is "as applied." If an abortion ban is alleged harm a woman's right to abortion, courts could consider the claims. Specifically, courts should determine whether the ban "subjected women to significant health risks." He added, however, that "safe medical options are available" -- leaving abortion-rights advocates at a loss. __NOEDITSECTION__ From The Opinion Wiki, a Wikia wiki.
