Evan Hayes was an Ensign in the United States Navy and who was also assigned to the USS Kennedy where his father, Captain Hayes had previously worked before retiring. Hayes was psychologically and emotional disturbed, his bizarre behavior the result of Commander Michael Dornan's constant ribbing. Gibbs and Kate eventually found Hayes inside an empty, darkened swimming pool and with Kate covering him, Gibbs attempted to talk Hayes into surrendering but Hayes stated that it was too late.

With his weapon raised, Hayes was about to make a beeline for Gibbs, forcing Kate to shoot him which she did, the impact of the gunshot killing Hayes instantly while Kate was left psychologically scarred by her actions although Gibbs insisted Hayes had committed suicide by cop.
