There is no specific time period for a separation to become a divorce. A divorce happens only when a court with proper jusisdiction enters a judgment declaring the parties to be divorced. Even a common law marriage where two persons have lived together as husband and wife for a certain period of time, requires a judicial divorce decree as opposed to just separating for a period of time.
