Holly had a solo recording contract under his own name, so to avoid legal problems he decided to form the group. Though often referred to as "Buddy Holly and the Crickets", they never went by that billing professionally. The songs Not Fade Away, Oh Boy!, and That'll Be the Day are all off of their debut album The "Chirping" Crickets released in 1957.
