Brian's brother, James Dempsey, not knowing what had happened kidnapped the NCIS Director Jennifer Shepard and held her hostage in exchange for his drugs shipment and Brian. With Agent Cassie Yates's help, NCIS were able to rescue Jenny and kill James in the process with an autopsy ruling later finding that a brain aneurysm was responsible for Brian's death and although it was possible that Ziva hitting him could have caused to the ever-expanding tumor to blow, it's likely that Brian had it since birth which had Ducky later ruling that Brian Dempsey's death was the result of natural causes and the case was closed for good.
