The finger unoccupied was the left little finger, that was Orochimaru's ring position. When Orochimaru defected from Akatsuki, took his ring with him, so the ring couldn't be given to a 10th member so there couldn't be one. Tobi only could join after Sasori died and Tobi retrieved his ring.
