I think you are somewhat confused. Dr. Hiruluk's flag is the same one later adopted by the Sakura Kingdom (what occupies Drum Island) and as Chopper's personal JR, as seen here: Trafalgar Law's flag isn't the conventional "Jolly Roger" like above, it is a new one, dubbed a "Smiley", as seen here: I hope this helps.
