It was never said that using the forbidden Itto Kaso spell would automatically result in him being banished. Other punishments do exist, just like in any real society/military. Except for Aizen's sentencing, nothing was seen or said of what happened in the immediate aftermath in Soul Society so we do not know anything about what may or may not have transpired regarding Yamamoto's use of the spell.
