A Mareva injunction or freezing order is a pre-trial remedy in civil cases which prohibits a party from removing any assets from the jurisdiction of the court. It is only available in British common law jurisdictions, not the United States or civil code legal systems. It is named after the case where it was created, Mareva Compania Naviera SA v International Bulkcarriers SA [1975] 2 Lloyd's Rep 509. Its purpose is to prevent a party who is being sued from removing all of their assets from the jurisdiction prior to a judgment in an attempt to make the judgement unenforceable except through costly and uncertain proceedings to attempt to enforce the judgment in another jurisdiction. Since 1998, it has been codified in British civil procedure.
