Judgment on the pleadings is a judgment rendered by a court prior to a verdict because no material issue of fact exists and one party is entitled to a judgment as a matter of law. It enables the moving party to have the court rule in its favor based on the merits of the pleadings. The court applies the same standard in a Rule 12(c) motion as it does in a Rule 12(b)(6) motion, and the court must accept as true the allegations contained in the pleading and draw all reasonable inferences in favor of the non-moving party. "A party is entitled to judgment on the pleadings only if it is clear that no material issues of fact remain to be resolved and that it is entitled to judgment as a matter of law."
