The Gigai remains empty and motionless, as it requires either a Shinigami, an Artificial Soul, or a Mod Soul to inhabit it, as a Gigai cannot move without a soul inside of it. Additionally, using Kon isn't mandatory for Ichigo, as his Substitute Shinigami Badge enables him to leave his body without the assistance of a Gikongan (namely, Kon's Mod Soul pill). Using Kon, however, enables for him to inhabit Ichigo's body, so he can leave his body without anyone being suspicious about it remaining motionless.
